Terms and Conditions

FUNTASTIC DEPOT PARTICIPANT AGREEMENT

WAIVER, RELEASE AND ASSUMPTION OF RISK

Please read these terms carefully before participating. By accepting, you agree to the following:

Participation in the Funtastic Depot Inflatable Concept Park and other park rides involves known, anticipated, and unanticipated risks that may result in physical and/or emotional injury, paralysis, death, or damage to yourself and/or others.

These risks include, but are not limited to: slipping and falling, improper landings, collisions with fixed or moving objects or other participants, which may result in sprains, fractures, breaks, scrapes, bruises, dislocations, and injuries to the head, back, and neck.

Notice to the Minor Child’s Natural Guardian

By signing this form, you agree to allow your minor child to participate in a potentially dangerous activity. Even if reasonable care is provided, there is still a risk of serious injury or death.

You understand that certain inherent risks cannot be eliminated. By agreeing, you waive the right to pursue legal action against the park owner for injuries, damages, or death resulting from participation.

You have the right to refuse to sign this agreement. However, the park reserves the right to deny participation if this form is not signed.

Acknowledgment of Terms

By providing your information, you confirm your understanding and acceptance of these terms.

Funtastic Depot Hoffner LLC (the “Park Owner”) provides access to its facilities and activities. By participating, you agree to the following:

Participation Agreement

On behalf of yourself, your spouse, children, and any individuals under your care:

You agree to use the park safely and responsibly.
You acknowledge that events may include lighting effects, flashing lights, smoke, and other elements that may trigger sensitivities or medical conditions.
You confirm that you will not participate if you have health conditions that could be affected by these elements.
You agree to follow all park rules and staff instructions. Failure to comply may result in removal without refund.
You agree to report any injury immediately and stop participation if necessary.

Waiver and Release of Liability

You agree to fully waive and release the Park Owner from any and all claims, liabilities, damages, or legal actions arising from:

Participation in park activities
Use of facilities and equipment
Actions of other participants
Any alleged negligence

This includes all current and future claims, whether known or unknown.

Indemnification

You agree to indemnify and hold harmless the Park Owner from any claims, damages, costs, or legal fees resulting from your participation or actions within the park.

Assumption of Risk

You acknowledge that participation is voluntary and that you assume all associated risks.

You confirm that:

You are physically fit to participate
You have no medical conditions that could be worsened by activity
You will not participate under the influence of drugs or alcohol

Safety and Media Consent

You agree to watch any required safety instructions before participating.
You will only engage in activities you feel capable of performing safely.
You accept responsibility for any injuries or damages incurred.
You grant permission to the Park Owner to capture and use your image, likeness, and recordings for marketing and promotional purposes without compensation.

Parent or Guardian Consent

If signing on behalf of a minor:

You confirm that you have full legal authority to consent on behalf of the child. All terms in this agreement apply equally to the minor.

You acknowledge that by signing, you waive important legal rights on behalf of both yourself and the minor.

If you are not the legal guardian, you confirm that you have been granted authority to sign. Otherwise, you accept full responsibility for any resulting claims or liabilities.

Final Agreement

By accepting these terms, you confirm that you have read, understood, and agree to all conditions outlined above.
